Terms of Service

These Terms of Service ("Terms") govern your use of BuilderPay ("the Service"), operated by BuilderPay. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

What BuilderPay is

BuilderPay is a software platform that helps UK contractors and tradespeople manage jobs, create and send invoices, track payments, and organise their business operations. BuilderPay is a business management tool — it is not an accounting service, tax advisory service, or legal service. You remain solely responsible for your business records, tax obligations, and compliance with applicable laws.

Eligibility

You must be at least 18 years old and operating a business or working as a self-employed tradesperson in the United Kingdom to use BuilderPay. You must provide accurate registration information and keep your account details up to date.

Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at privacy@builderpay.app if you suspect unauthorised access. We are not liable for losses arising from unauthorised use of your account where you have failed to keep credentials secure.

Acceptable use

You agree to use BuilderPay only for lawful business purposes. You must not:

  • Use the Service to send spam, fraudulent invoices, or misleading communications.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Upload malicious code or content that infringes third-party rights.
  • Resell, sublicense, or reverse-engineer the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these rules.

Subscription and payment terms

BuilderPay is offered on a subscription basis. Current pricing is displayed on our website. By subscribing, you authorise us to charge your payment method on a recurring monthly or annual basis, depending on the plan you select.

  • Free trial: New accounts receive a 14-day free trial. No credit card is required to start. After the trial, you must subscribe to continue using the Service.
  • Billing: Subscriptions renew automatically unless cancelled before the renewal date. Prices are quoted in GBP and include VAT where applicable.
  • Price changes: We may change subscription prices with at least 30 days' notice. Changes apply at your next renewal date.
  • Failed payments: If a payment fails, we will attempt to collect again and may suspend access until payment is received.

Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer refunds for partial billing periods except where required by law. Upon cancellation, your data will be retained in accordance with our Privacy Policy and then deleted.

Your data

You retain ownership of all business data you enter into BuilderPay. You grant us a limited licence to store, process, and transmit that data solely to provide the Service — for example, sending invoices on your behalf. Our handling of personal data is described in our Privacy Policy.

Service availability

We aim to keep BuilderPay available at all times but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our reasonable control.

Not an accounting service

BuilderPay helps you create invoices and track payments, but it does not provide accounting, bookkeeping, tax, or financial advice. Figures, reports, and exports are provided for your convenience only. You must verify all financial records with a qualified accountant or bookkeeper. We are not responsible for errors in your data entry or for any tax or regulatory consequences arising from your use of the Service.

Intellectual property

BuilderPay, its software, design, and branding are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or proprietary technology beyond the limited right to use the Service as described here.

Limitation of liability

To the fullest extent permitted by law:

  • BuilderPay is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted operation.
  • We are not liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption.
  • Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your business data, or your violation of these Terms or applicable law.

Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
